What Is AI Bias?

The training data doesn't represent the real world, or it reflects historical patterns of discrimination.

Selection Bias

Why AI Bias Matters for Australian Businesses
Legal Risk
Australian anti-discrimination law prohibits discrimination on the basis of protected attributes including race, sex, age, disability, sexual orientation, and others. This applies whether the discrimination is carried out by a human or an algorithm.

How to Test for AI Bias
Step 1 - Define Fairness Criteria
Before you can test for bias, you need to define what fairness means for your specific application. There's no single definition of fairness - different criteria can be appropriate in different contexts.
Common fairness criteria:
Demographic parity: The AI produces positive outcomes at equal rates across groups. For example, a lending model approves the same percentage of applications from each demographic group.
Equal opportunity: The AI is equally accurate across groups for positive outcomes. For example, among applicants who would repay a loan, the model approves the same percentage regardless of demographic group.
Predictive parity: The AI's predictions are equally accurate across groups. For example, among applicants the model approves, the same percentage from each group actually repay their loans.
Individual fairness: Similar individuals receive similar outcomes, regardless of group membership.
Which to choose depends on context. For high-stakes decisions (credit, employment, insurance), we generally recommend testing against multiple criteria and discussing trade-offs with stakeholders.
Step 2 - Identify Protected Groups
Determine which demographic groups to test across. In Australia, protected attributes include:
- Age
- Sex and gender identity
- Race, colour, ethnic origin
- Disability
- Sexual orientation
- Marital status
- Religion
- Pregnancy and breastfeeding
- Political opinion (in some jurisdictions)
- Indigenous status
You may not always have demographic data for all attributes. Where you do, test. Where you don't, consider whether proxy variables might indicate disparate impact.
Step 3 - Analyse Training Data
Before testing the model, analyse the training data:
- Is each group adequately represented?
- Are outcome labels consistent across groups?
- Are there historical patterns of discrimination in the data?
- Do feature distributions differ across groups in ways that could drive bias?

Step 4 - Test Model Outputs
Run bias tests on the model's outputs:
Quantitative testing:
- Calculate outcome rates by group
- Measure accuracy metrics by group (precision, recall, false positive rate, false negative rate)
- Compute fairness metrics (demographic parity ratio, equalised odds difference, etc.)
- Test at different thresholds and operating points
Qualitative testing:
- Review individual decisions for different demographic profiles
- Test with synthetic cases that differ only in protected attributes
- Have diverse reviewers assess AI outputs for bias
- Test with edge cases and underrepresented scenarios
Step 5 - Assess and Address
If bias is found:
- Determine the source - Is it data bias, selection bias, measurement bias, or algorithmic bias?
- Assess the severity - How large is the disparity? How many people are affected?
- Evaluate legal exposure - Does the bias create legal risk under anti-discrimination law?
- Plan remediation - What changes will reduce or eliminate the bias?
- Implement and retest - Make changes and verify they've worked
Common remediation approaches:
Data-level:
- Collect more representative training data
- Re-balance training data across groups
- Remove or replace biased labels
- Apply data augmentation for underrepresented groups
Model-level:
- Add fairness constraints to the model training process
- Use models that are more interpretable and auditable
- Adjust thresholds differently for different groups (where legally appropriate)
- Use ensemble approaches that combine fairness-aware models
Post-processing:
- Adjust outputs to meet fairness criteria
- Apply different decision thresholds where justified
